Government project of Act on marine equipment is already in Parliament

On 4 November this year the first reading of the draft Act on marine equipment was held in the Parliament.This project was approved by the Council of Ministers at the beginning of October and its author is the Ministry of Maritime and Inland Navigation.

The solutions proposed in the project aim at adapting the provisions on marine equipment to the rules laid down by the European Union in so called New Regulatory Framework (Decision of the European Parliament and of the Council No 768/2008/EC of 9 July 2008 and Regulation of the European Parliament and Council Regulation (EC) No 765/2008 of 9 July 2008), which will contribute to the uniform and harmonized application of the rules of market surveillance on marine equipment, in particular in the field of comprehensive and precise definition of duties of entities in the market, improve the monitoring of notified bodies and improve the effectiveness of the so called the safeguard clause by market surveillance authorities.

The draft also seeks to take adequately into account the specifics of the marine equipment market, by the introduction in this respect the principles of New Legislative Framework in their modified scope, which allows to avoid the imposition of inappropriate burdens and responsibilities for business entities, notified bodies and government bodies in the discussed sector.

The proposed rules are to replace the previously valid Act of 20 April 2004 on marine equipment.
